BINDING EFFECT

The following General Terms and Conditions apply to trainings of Acadimate which are conducted by Associmates GmbH. Please note that by submitting your registration, you agree to these Terms without modification, and you enter a binding contract with us when you purchase a ticket to or register for the Training.

REGISTRATION CONFIRMATION

You agree and understand that your registration for the training is subject to our confirmation that will be sent to you via email. We are entitled to deny your registration without cause. Your registration fee covers the costs of the training, lunch, and coffee breaks for the mentioned days of the respective trainings. You are as well entitled to a complimentary group dinner. You are required to bring your own laptop. 

PROGRAM CHANGES

It may be necessary to change the training content and timing, the speakers, the date, or the venue at any time prior to the training. In that case, we will notify you and you will be given the opportunity to cancel your registration. Should you decide to cancel your registration for these grounds, we are not responsible nor liable for any costs and/or expenses you may incur due to the cancellation of your registration.

CANCELLATION/TRAINING POSTPONEMENT BY THE HOST

We, Associmates, may at any time, with or without giving notice, in absolute discretion and without giving any reason, cancel your registration and/or cancel or postpone the training, whether physical or virtual, change its venue or any of the other published particulars, or withdraw any invitation to attend. In case of cancellation of your registration and/or cancellation of the training by us, the paid training fees (if any) will be reimbursed to you in due time. We will carry out such reimbursement using the same means of payment as you used for the initial transaction. In case of postponement of the training, the paid training fees (if any) will not be refunded. Should the training be postponed or cancelled, we are not responsible nor liable for any costs and/or expenses you may incur due to the postponement and/or cancellation of the training.

CANCELLATION BY PARTICIPANTS

In case of cancellation, the following cancellation costs applies

1. If cancelled 2 weeks month prior to the scheduled date, 25% of the fee will be refunded.

2. If cancelled 1 month prior to the scheduled date, 50% of the fee will be refunded.

3. If cancelled 2 months and prior to the scheduled date, 75% of the fee will be refunded.

In case of no show, no amount will be refunded. In case of substitution of the trainee, please inform us 45 days prior to the scheduled date. Otherwise, it is not possible to substitute.

TRAVEL AND HOTEL ACCOMMODATION (WHERE APPLICABLE)

You are fully responsible for making your own travel and accommodations arrangements. It is recommended that you check your visa requirements with your local embassy or consulate. We will not be liable for any travel or accommodation formalities and/or expenses or if you are unable to attend the training due to a Force Majeure training or any event out of our control. We recommend you subscribe appropriate insurance against cancellation as well as to have adequate health and accident insurance.

ASSISTANCE - DIETARY REQUIREMENTS (WHERE APPLICABLE)

If you need any special assistance (e.g., in relation to a person who is blind/visually impaired or a person with a physical disability, please contact the training organizer in advance by email to arrange such assistance at the venue. Where applicable, you will be given the opportunity to mention any dietary requirement in the registration form and/or through the subscription process.

DATA PROTECTION

By registering and/or by participating to the training wherever physically or virtually via video conferencing or web conferencing platforms/tools, you acknowledge that your personal data will be collected and processed by us to organize such training and manage your participation. Please note that your data may be shared with the Organization for which you work for, for staff management purposes, to allow us to ensure adequate follow-up and best services to its members.

PHOTOGRAPHY AND FILMING

By registering and/or by participating to the training wherever physically or virtually via video conferencing or web conferencing platforms/tools, you acknowledge that certain sessions and/or social functions may be, photographed and/or filmed and/or web streamed and that some of these photos and video recordings can be used for the minutes of training/meeting, news, promotional purposes, future marketing materials, illustration, information and dissemination activities via our own websites or inclusion on our social media pages which may process personal data according to their own policies. Participation in the training (whether online or not), indicates your consent to being included in the meeting’s recording. Should you have any concerns about this, or do not wish to be featured in any of these materials, please approach the training planner and inform her/him on the day of the training. However, you are advised that incidental inclusion of some images of yourself within any recording or photos may take place. Photos and recordings will be publicly available.

INTELLECTUAL PROPERTY

You agree that all elements made available by us or made available via the our company in connection with the training, including, without limitation, notes, records, studies, reports, brochures, drawings or other documents and tangible items including images, texts, comments, graphics, illustrations, logos, icons, the brand and products names, are (i) the exclusive property of the Associmates GmbH, and/or of its licensors and (ii) could be protected by Intellectual Property Rights. We reserve all rights not expressly granted under these Terms.

MARKETING

Please note that individuals and organizations cannot exhibit or hand out marketing material or other printed matter during the training, unless by seeking prior consent from us. Individuals and organizations wishing to display such marketing materials may contact us.

CONDUCT AT THE TRAINING

We are dedicated to making the training a safe place for all.

You shall not display any content, adopt a conduct, or incite any person to commit an act, which: 

1. is threatening, libelous, defamatory, or obscene.

2. would constitute a criminal offense, give rise to civil liability, or otherwise violate law in any manner.

3. infringes the intellectual property, privacy, or other rights of any third parties; or

4. constitutes or contains false or misleading statements.

You consent also not to hack or use our infrastructure for unethical, illegal, or malicious activities. We may at any time, with or without giving notice, in our absolute discretion, rescind your registration or attendance at the training in case of violation of these Terms without incurring any liabilities to you and/or any third party. In such event, all paid training fees will not be reimbursed, and all training fees shall remain due.

LIABILITY

The Organizer, its statutory agents and persons employed to perform obligations on behalf of the organizer, shall be liable only for damage caused by intent or gross negligence. In the event of gross negligence, liability shall be limited to the amount of the participation fee. Any liability for consequential damage and damage to property (such as lost profit) will be excluded. The limitation of liability and/or exemption from liability shall neither apply in the event of injury to life, body, or health nor in the event of claims under the German Product Liability Act. Furthermore, the Organizer and his/her agents in performance will not accept any liability for disturbances of whatever kind which are caused by circumstances beyond his/her/their reasonable control. Any liability for damages arising from travel to and from the event locations as well as from loss and accidents shall be excluded to the legally permitted extent. We assume no liability for damages and/or losses arising from the use or sharing of what is learned and/or communicated as part of the event.

UPDATE OF TERMS & CONDITIONS, GOVERNING LAW, AND JURISDICTION

​These Terms are effective from 01 January 2023 and shall apply to your registration for and/or your participation to the training. We may update these Terms at any time. Consequently, you are invited to regularly refer to the latest Terms in effect when you proceed to a registration and/or subscription. All claims arising out of or in connection with these General Terms and Conditions of trainings shall be subject to German law. If Participant is a merchant (Kaufmann), a legal entity under public law, or a special asset fund under public law, the place of jurisdiction for all disputes arising out of or in connection with these General Terms and Conditions of Events is Bonn.
